Constructing the restriction and supervision system of state-owned enterprises’ power operation

The Third Plenary Session of the 18th CPC Central Committee pointed out that it is the fundamental policy to keep power in a cage by insisting on using the system to manage affairs and people, letting the people supervise power and letting power run in the sun. In recent years, Chongqing’s state-owned enterprises have made remarkable achievements in establishing and improving the modern property right system, giving full play to the political core role of the party organization, and exploring the establishment of a restriction and supervision system for power operation, which has played an important role in promoting the reform and development of state-owned enterprises. However, the current situation of building a clean and honest government and fighting against corruption in state-owned enterprises in our city is still grim. When the Fifth Inspection Team of the Central Committee gave feedback to our city, it pointed out that "there are hidden dangers of corruption in state-owned enterprises, and the problem of’ fly’ corruption is more prominent". For state-owned enterprises, to thoroughly implement the spirit of the Third Plenary Session of the 18th CPC Central Committee, ensure the healthy operation of state-owned assets, preserve and increase their value, and effectively prevent "fly" corruption, it is necessary to build an operating system with scientific decision-making, firm implementation and strong supervision, and improve the system of punishing and preventing corruption, the core of which is to strengthen the checks and balances of power and restrict and supervise power.

Scientific and rational distribution of power

Acton, a British intellectual historian, famously said, "Power leads to corruption, and absolute power leads to absolute corruption." Whether the power distribution is scientific and reasonable is related to whether the power ecology is optimized and whether the power operation is smooth. If the power pattern is unbalanced, the powers and responsibilities are unclear, the powers and responsibilities are asymmetrical, and the power is excessively concentrated in the hands of a few people, it will inevitably lead to power abuse and corruption. Therefore, it is necessary to clearly define the scope of authority and basic functions of the Party Committee, the Board of Directors, the executive level, the Board of Supervisors, the Commission for Discipline Inspection, and various departments, units and posts, and make an "operation flow chart" of each authority in accordance with the requirements of statutory authority and consistency of power and responsibility, so as to lock the boundary of power operation. So that power can run on the established track and according to the established route, and truly realize "putting power in a cage", forming a guarantee mechanism that is not easy to corrupt and a disciplinary mechanism that does not dare to corrupt.

According to the spirit of the Third Plenary Session of the 18th CPC Central Committee, the State-owned Assets Supervision and Administration Commission of the State Council pointed out that by 2020, except for a few special fields, most state-owned enterprises will develop into mixed-ownership enterprises, and state-owned capital can implement absolute holding, relative holding and equity participation, as well as preferred shares and gold shares. The original state-owned enterprises are no longer pure and pure state ownership, realizing the diversification of investment subjects. The formation of mixed ownership will inevitably lead to the general meeting of shareholders, the board of directors, the executive level and the board of supervisors. This kind of assets and management structure embodies the power structure of coordination and restriction of decision-making, execution and supervision, but it cannot cancel the political leadership of the party Committee of state-owned enterprises. The party Committee and the discipline inspection commission cannot be excluded from the high-level decision-making circle, but can enter the decision-making level and the supervision level respectively, participate in major decision-making processes and implement guarantee supervision according to law. In accordance with the requirements of modern enterprise system, Party committees should give full play to the role of political core and guarantee supervision, actively support the establishment and improvement of corporate governance structure, scientifically divide the respective functions of shareholders’ congress, board of directors, executive layer and board of supervisors, rationally distribute power, monitor power in a timely manner, and create a good power ecology of enterprises with both division of labor and cooperation, both subject and affiliation, and both operation and control.

Orderly supervision power according to law

Grasp the key nodes of power operation. The operation of power has its own laws, and it is bound to reflect the running track, and several key nodes often appear. These key nodes can not only be the "focal point" where power acts on work, but also the "turning point" where power is easy to change, and even become the "prone point" for power and money transactions and power and color transactions. Therefore, in key areas, key links and key positions, we should focus on monitoring and strictly guard against death, cut off the channels of power and money trading, power and property trading and power trading, and prevent power from changing. Over the years, Chongqing Environmental Sanitation Group has taken effective measures to prevent power monopoly, implement division of labor and collective decision-making and avoid corruption around key areas and key links such as project contracting, fund management and material procurement. If we insist on auditing the economic responsibility of the principal responsible persons of subordinate units every year, the principal responsible persons will implement the lifelong accountability system for the projects under their control. At the same time, strictly control the key links of project management, implement and manage the project bidding in a unified way, and implement internal multi-department countersignature of bidding documents. Even for projects that are not allowed to bid for less than 500,000 yuan, strict management measures have been formulated, and the "separation of management and procurement" has been strictly implemented. For the procurement of daily materials and bulk materials, shopping around, fixed-point procurement, regular comparison and regular replacement of merchants have been implemented, and the Group Commission for Discipline Inspection has supervised the whole process of bidding and procurement.

Establish an all-round, multi-level and multi-faceted power operation restriction and supervision system. Chongqing Environmental Sanitation Group made full use of various forms of supervision to supervise the members of the leading group and achieved remarkable results. For example, the system of leading cadres’ reporting on major personal matters, debriefing and honesty, democratic appraisal, admonishing in conversation and replying to letters and inquiries from organizations should be strictly implemented, and supervision and inspection should be strengthened to ensure that these systems are implemented. Adhere to and improve democratic centralism, urge leading bodies at all levels to establish and improve rules of procedure and decision-making procedures, and conscientiously implement the system of combining collective leadership with individual division of responsibilities. Adhere to the "three majors and one big" decision-making mechanism, and resolutely prevent "paternalism" and "one word". All major decisions, appointment and removal of important cadres, major project arrangements and the use of large amounts of funds must be made collectively by the leading bodies. Further strengthen the clean government management of key positions and departments such as material procurement, equipment maintenance, bidding and engineering construction. In particular, according to the characteristics of projects or new projects and new units under construction, corresponding prevention and control measures should be formulated in time to ensure that there are no dead ends and loopholes in the system coverage and effectively prevent the "leakage" of funds.

Adhere to the party’s mass line and rely on the masses to fight corruption and promote honesty. Generally, people who engage in corruption are always arrogant, divorced from the masses, superstitious about power and playing politics, and are keen on formalism, bureaucracy, hedonism and extravagance. However, the fox’s tail can’t be hidden. As long as the masses are widely mobilized, let the masses participate and supervise the operation of power, and let the power run in the sun, the probability of power mutation can be reduced. Chongqing Environmental Sanitation Group pays attention to the establishment of a mass anti-corruption system, allowing the masses to participate in decision-making, making factory affairs public, setting up a report telephone and email address, so that everyone can keep their eyes open, ears open and take responsibility, and keep a high pressure on possible corruption, forming a shocking atmosphere in which "tigers" and "flies" fight together. The Environmental Sanitation Group pays special attention to grasping the early and the small, grasping the so-called trivial matters, small mistakes and small problems. It often takes "preventive shots" and "small alarm bells" for party member and cadres, and immediately investigates and deals with problems when they are found, helping comrades to correct their mistakes and avoid causing greater consequences, thus forming a good situation in which everyone is self-disciplined and upright. Over the years, Chongqing Environmental Sanitation Group has not had a corruption case caused by violation of law and discipline, which has provided a solid political and disciplinary guarantee for the development of the group.
