Seventeen departments： support more high-quality small and medium-sized enterprises to land in the capital market
BEIJING, July 24 (Xinhua) According to the website of the Ministry of Industry and Information Technology, a few days ago, 17 departments including the Ministry of Industry and Information Technology and the National Development and Reform Commission jointly issued "Several Opinions on Improving the System of Supporting the Development of Small and Medium-sized Enterprises" (hereinafter referred to as "Opinions"). The Opinions propose to improve the direct financing support system for small and medium-sized enterprises, steadily promote the reform of the registration system with information disclosure as the core, and support more high-quality small and medium-sized enterprises to land in the capital market. Encourage small and medium-sized enterprises to connect with the capital market through mergers and acquisitions.
The following is the full text of the opinion:
First, improve the basic system to support the development of small and medium-sized enterprises
(1) Improve the laws and regulations system for small and medium-sized enterprises. On the basis of the Law on the Promotion of Small and Medium-sized Enterprises, we will speed up the construction of a legal and regulatory system with China characteristics that supports the development of small and medium-sized enterprises and protects their legitimate rights and interests. Encourage local governments to formulate local laws and regulations to promote the development of small and medium-sized enterprises according to law. Explore the establishment of laws and regulations evaluation system and implementation inspection system for small and medium-sized enterprises, and urge laws and regulations to be put in place.
(2) Adhere to the system of fair competition. We will fully implement the negative list system for market access, treat small and medium-sized enterprises fairly, get rid of unreasonable thresholds and restrictions, and realize equal rights, opportunities and rules for large, medium and small enterprises and various ownership economies. Fully implement the fair competition review system, improve the review process and standards, and establish and improve the fair competition review complaints, publicity and spot checks system. Strengthen and improve anti-monopoly and anti-unfair competition law enforcement and maintain market competition order.
(3) Improve the statistical monitoring and publishing system for small and medium-sized enterprises. Improve the statistical monitoring system of small and medium-sized enterprises, and regularly publish statistical data of small and medium-sized enterprises. Establish a survey and statistics system on the financing situation of small and medium-sized enterprises, and compile the financial condition index of small and medium-sized enterprises. Strengthen the structural analysis of small and medium-sized enterprises and improve the level of statistical monitoring and analysis. Explore the use of big data and other means to carry out monitoring and analysis of small and medium-sized enterprises. Improve the handbook "Main Statistics of Small and Medium-sized Enterprises" and study and compile the development index of small and medium-sized enterprises. Revise the classification standards of small and medium-sized enterprises in a timely manner.
(4) Improve the credit system for small and medium-sized enterprises. Adhere to the "government+market" model, establish and improve the collection, sharing and inquiry mechanism of credit information for small and medium-sized enterprises, and integrate and share all kinds of public service data related to enterprises in a timely manner based on the national credit information sharing platform. Establish and improve the credit evaluation system for small and medium-sized enterprises, improve the basic database of financial credit information, innovate credit information products for small and micro enterprises, and efficiently dock financial services. Study and promulgate relevant laws and regulations to standardize the collection of credit information, public inquiry and credit supervision of small and medium-sized enterprises. Give full play to the basic role of the national enterprise credit information publicity system, and record the enterprise-related information in the name of the enterprise and publicize it according to law.
(5) Improve the fair supervision system. Reduce regulatory matters, simplify procedures, promote the whole process of online operation, guide the deputy, and comprehensively implement the reform of credit supervision and "internet plus supervision". Promote hierarchical classification and cross-departmental joint supervision, strengthen and standardize post-event supervision, implement and improve inclusive and prudent supervision, avoid taking simple and rude measures against small and medium-sized enterprises, and severely investigate and deal with "one size fits all" behaviors.
Two, adhere to and improve the financial support system for small and medium-sized enterprises.
(6) Improve an accurate and effective financial support system. The central government set up small and medium-sized enterprises, and the finance at or above the county level arranged special funds for the development of small and medium-sized enterprises according to the actual situation. Establish a national SME development fund company as a parent fund, improve the fund management system, improve the fund market-oriented operation mechanism, and guide qualified local governments to set up SME development funds. Improve the management methods of special funds and strengthen the performance evaluation of funds.
(seven) to establish a long-term mechanism to reduce the tax burden of small and micro enterprises. Implement a tax policy that is conducive to the development of small and micro enterprises, and implement measures such as deferring, reducing, exempting enterprise income tax and value-added tax for qualified small and micro enterprises in accordance with the law, and simplify tax collection and management procedures; Preferential policies such as reduction and exemption of administrative fees for small and micro enterprises will be implemented to reduce the tax burden of small and micro enterprises. We will implement the list system of enterprise-related charges, strengthen supervision and inspection of enterprise-related charges, and clean up and standardize enterprise-related charges.
(eight) to strengthen the policy mechanism of government procurement to support small and medium-sized enterprises. Revise the Interim Measures for Government Procurement to Promote the Development of Small and Medium-sized Enterprises, improve measures such as reserved procurement share and preferential price evaluation, and increase the share of small and medium-sized enterprises in government procurement. Reserved procurement share for small and medium-sized enterprises should account for more than 30% of the total annual government procurement project budget of this department; Among them, the proportion reserved for small and micro enterprises is not less than 60%.
Third, adhere to and improve the SME financing promotion system
(9) Optimize the monetary and credit transmission mechanism. Comprehensive use of small loans, rediscounting, differential deposit reserve ratio and other monetary policy tools to guide commercial banks to increase credit supply for small and micro enterprises. Further dredge the interest rate transmission channels to ensure that the loan market quoted interest rate (LPR) is effectively transmitted to the loan interest rate. Establish a differentiated interest rate pricing mechanism for small and micro enterprises, promote the openness and transparency of credit interest rates and fees, and maintain a reasonable level of loan interest rate pricing for small and micro enterprises.
(10) Improve the multi-level financial service system for small and micro enterprises. Promote the construction of inclusive financial system, deepen the reform of large and medium-sized banks in inclusive finance, and promote the orderly and healthy development of small and medium-sized banks, non-deposit financial institutions and internet finance. Encourage financial institutions to innovate products and services, develop convenient loan renewal business and credit loans, increase small and micro enterprises’ first loans, medium and long-term loans and intellectual property pledge loans, carry out supply chain finance and accounts receivable financing, and strengthen the interaction between banks and taxes. Promote financial technology and empower financial institutions to serve small and medium-sized enterprises. Study and promulgate the Regulations on Non-deposit Lending Organizations. Accelerate the construction of mechanisms such as rapid settlement of microfinance disputes. We will improve and standardize the regulatory laws and regulations on banking-related enterprise service charges, and reduce the comprehensive financing costs of small and micro enterprises.
(eleven) to strengthen the financial differentiation supervision and incentive mechanism of small and micro enterprises. We will improve the long-term mechanism for the supervision of financial services for small and micro enterprises in commercial banks and issue the Measures for the Supervision and Evaluation of Financial Services for Small and Micro Enterprises in Commercial Banks. Revise the Measures for Performance Evaluation of Financial Enterprises. Link the service situation of small and micro enterprises in commercial banks with capital replenishment, financial bond issuance, macro-prudential assessment (MPA) assessment, and assessment and appointment of relevant heads of financial institutions. Guide banking financial institutions to explore the establishment of a negative list system for credit due diligence exemption. Supervise commercial banks to optimize the allocation of internal credit resources and the assessment and incentive mechanism, separate credit plans for small and micro enterprises, and improve loan service methods.
(12) Improve the direct financing support system for SMEs. Vigorously cultivate the venture capital market, improve the incentive and withdrawal mechanism of venture capital, guide angel investors, private equity and venture capital to expand equity financing of small and medium-sized enterprises, and invest more in long-term, early-term, small-scale and innovation. We will steadily promote the reform of the registration system with information disclosure as the core and support more high-quality small and medium-sized enterprises to land in the capital market. Encourage small and medium-sized enterprises to connect with the capital market through mergers and acquisitions. We will steadily promote the reform of the New Third Board and improve the listing mechanism of listed companies. We will improve the training mechanism for small and medium-sized enterprises to go public, and encourage local governments to increase their support for small-scale enterprises that have upgraded their regulations, changed their regulations and listed their shares. Increase high-quality SME bond financing, develop more types of bonds suitable for SMEs through market-oriented mechanisms, improve the credit enhancement mechanism of SME bond financing, and expand the scale of bond financing.
(XIII) Improve the financing guarantee system for small and medium-sized enterprises. Improve the government financing guarantee system, give full play to the role of the national financing guarantee fund, implement the policy of reducing fees and awards for small and micro enterprises’ financing guarantee, improve the risk compensation mechanism and performance appraisal incentive mechanism, and guide government financing guarantee institutions at all levels to expand the financing guarantee business scale of small and micro enterprises and reduce the guarantee rate level. Encourage banking financial institutions to increase cooperation with government financing guarantee institutions, reasonably determine the risk sharing ratio and the risk weight of secured loans, implement the due diligence exemption system for financial institutions and financing guarantee institutions, and improve the financing availability of small and micro enterprises. Promote the establishment of a unified registration and publicity system for chattels and rights guarantees.
Four, establish and improve the innovation and development system of small and medium-sized enterprises.
(fourteen) improve the entrepreneurial support system. Improve the entrepreneurial environment and cultivate entrepreneurs extensively. Improve the construction of entrepreneurial carriers, improve the support and evaluation mechanism, and provide low-cost, convenient and high-quality services for small and micro enterprises to start businesses. Encourage large enterprises to give full play to their technological advantages, talent advantages and market advantages to provide support for entrepreneurial activities. Encourage service agencies to provide standardized and professional services related to entrepreneurship.
(fifteen) improve the innovation support system for small and medium-sized enterprises. Innovate the deep integration mechanism of small and medium-sized enterprises in Industry-University-Research, promote the joint participation of large and medium-sized enterprises in major scientific and technological projects, and promote the opening of innovative resources such as scientific research instruments, experimental facilities and pilot bases of universities, research institutes and large enterprises to small and medium-sized enterprises. We will adjust and improve the way of establishing scientific and technological plans, deploying tasks and organizing management, greatly increase the proportion of small and medium-sized enterprises undertaking R&D tasks, and increase direct support for R&D activities of small and medium-sized enterprises. We will improve the specialized market-oriented innovation service system, improve the national technology innovation center, manufacturing innovation center and other mechanisms to support the innovation of small and medium-sized enterprises, and enhance the ability and level of supporting the innovation of small and micro enterprises, such as entrepreneurial innovation demonstration bases, technology business incubators, specialized creative spaces, and university science parks. Improve the introduction and cultivation system of innovative talents in small and medium-sized enterprises, and optimize the mechanism of talent incentive and rights protection. Encourage small and medium-sized enterprises to innovate in technology, products and models with an inclusive and prudent attitude.
(sixteen) improve the development mechanism to support small and medium-sized enterprises. Improve the gradient cultivation system, standard system and evaluation mechanism of "specialized and innovative" small and medium-sized enterprises, "small giant" enterprises and single champion enterprises in manufacturing industry, and guide small and medium-sized enterprises to take the road of "specialized and innovative". We will improve the system of collaborative innovation and development of large, medium and small enterprises and various subjects, give play to the leading and supporting role of large enterprises, and improve the professional ability and level of small and medium enterprises.
(seventeen) to build a new technology application mechanism based on information technology. Support small and medium-sized enterprises to develop and apply new generation information technologies such as 5G, industrial Internet, big data, cloud computing, artificial intelligence and blockchain, as well as new material technologies, intelligent green service manufacturing technologies and advanced and efficient biotechnology, improve the working mechanism for supporting small and medium-sized enterprises to apply new technologies, and improve the digitalization, networking, intelligence and greening level of small and medium-sized enterprises. Support industrial parks and industrial clusters to improve the supporting capacity of infrastructure, establish a public service platform for new technologies of small and medium-sized enterprises, improve the promotion mechanism of new technologies, and improve the overall application level of high and new technologies in parks and industrial chains.
Five, improve and optimize the service system of small and medium-sized enterprises
(eighteen) improve the service system for small and medium-sized enterprises. We will improve the service system for small and medium-sized enterprises that combines government public services, market-oriented services and socialized public welfare services, and improve the benign development mechanism of service institutions and the gradient cultivation, collaborative services and evaluation incentive mechanism of public service platforms. Explore the establishment of an integrated platform for public services for small and medium-sized enterprises nationwide. Develop the service industry of small and medium-sized enterprises, guide service organizations to provide standardized, refined and personalized services, and guide large enterprises to provide supporting services for small and medium-sized enterprises in combination with industrial chain, supply chain, value chain and innovation chain. Encourage all kinds of social organizations to provide public welfare services for enterprises and explore the establishment of voluntary service mechanisms.
(nineteen) improve the mechanism to promote the management of small and medium-sized enterprises. Improve the training system for small and medium-sized enterprises, build a curriculum, teaching materials, teachers and organizational system with the characteristics of the times, build a massive open online course platform, and build a multi-field, multi-level and online-offline training system for small and medium-sized enterprises. Improve the system of training, using, evaluating and encouraging skilled personnel, speed up the training of high-quality skilled personnel, and carry forward the "artisan spirit". Improve the brand cultivation mechanism of SMEs. Implement actions to improve the quality management of small and micro enterprises. Improve the management consulting service mechanism of SMEs.
(twenty) to consolidate the international exchange and cooperation mechanism of small and medium-sized enterprises. Deepen the cooperation mechanism of bilateral and multilateral small and medium-sized enterprises and promote international exchanges and cooperation of small and medium-sized enterprises. Explore the construction of overseas service system for small and medium-sized enterprises, consolidate the service mechanism for international development of small and medium-sized enterprises, and provide assistance to small and medium-sized enterprises in international business legal consultation, intellectual property protection, technical trade measures and quality certification. Support qualified places to build Sino-foreign small and medium-sized enterprise cooperation zones and improve the evaluation and incentive mechanism. Promote the reform of tariff guarantee insurance. Encourage the development of new formats such as cross-border e-commerce, explore the establishment of B2B export supervision system, and support cross-border e-commerce to enter and exit.
Six, establish and improve the system of protecting the legitimate rights and interests of small and medium-sized enterprises.
(twenty-one) to build a system to protect the legitimate property rights of small and medium-sized enterprises and entrepreneurs. Resolutely protect the legitimate property rights of small and medium-sized enterprises and entrepreneurs, and punish illegal and criminal acts that infringe on the legitimate rights and interests of investors, managers and employees of small and medium-sized enterprises according to law. Measures such as seizure, seizure and freezing shall be taken in strict accordance with legal procedures, and illegal income, other property involved in the case and legal property shall be strictly distinguished according to law, the property of an enterprise as a legal person and the personal property of shareholders shall be strictly distinguished, and the personal property of persons involved in the case and the property of family members shall be strictly distinguished. Establish a long-term mechanism for the governance of government-related property rights disputes. Promulgate and implement the "Regulations on Safeguarding Payment of Small and Medium-sized Enterprises" to curb the problem of arrears from the source.
(twenty-two) improve the intellectual property protection system for small and medium-sized enterprises. We will improve laws, regulations and policies on intellectual property protection, establish and improve the punitive damages system, and increase the statutory compensation. We will implement the intellectual property strategy promotion project for small and medium-sized enterprises, strengthen the construction of intellectual property service industry cluster development zones, strengthen the patent navigation mechanism, improve policies to support small and medium-sized enterprises to develop independent intellectual property technologies and products, and enhance their ability to create, use, protect and manage intellectual property rights. Optimize the intellectual property rights protection mechanism of small and medium-sized enterprises and build a number of intellectual property protection centers. Construct a diversified solution mechanism for intellectual property disputes, strengthen the public service of intellectual property information for small and medium-sized enterprises, and promote arbitration and mediation of intellectual property disputes. Improve the efficiency of intellectual property review and reduce the cost burden of small and medium-sized enterprises to apply for and maintain intellectual property rights.
(twenty-three) improve the rights relief system for SMEs. We will build a unified platform for reporting government consultation complaints, smooth the channels for small and medium-sized enterprises to express their demands, and improve the handling procedures for reporting consultation complaints and the supervision and assessment mechanism. Explore the establishment of public interest litigation system for small and medium-sized enterprises and international rights protection service mechanism. Encourage legal service institutions to carry out public service of legal consultation for small and micro enterprises. Establish and improve the emergency rescue and relief mechanism for small and medium-sized enterprises to help them cope with force majeure events such as natural disasters, accidents, public health incidents and social security incidents.
Seven, strengthen the organization and leadership system to promote the development of small and medium-sized enterprises.
(twenty-four) to strengthen the working mechanism of promoting the development of small and medium-sized enterprises at all levels. The local people’s governments at or above the county level must establish and improve the leading group for promoting the development of small and medium-sized enterprises, with the government leader as the leader of the leading group and the office located in the comprehensive management department responsible for the promotion of small and medium-sized enterprises, and strengthen the construction of the work team for promoting the development of small and medium-sized enterprises. The leading group should hold regular meetings to study and implement the major decision-making arrangements of the CPC Central Committee and the State Council to promote the development of small and medium-sized enterprises, and report the relevant work to the office of the leading group at the next higher level in a timely manner. All members of the leading group should conscientiously implement the matters agreed by the leading group, establish an internal responsibility system, and strengthen the implementation of the work.
(twenty-five) to improve the decision-making mechanism of small and medium-sized enterprises. We will improve the policy consultation system for SMEs, cultivate a number of new think tanks with China characteristics that focus on SME research, and establish a system of soliciting opinions from SMEs and experts before the introduction of policies and a system of evaluating the effect of policy implementation. Improve the policy release, interpretation and public opinion guidance mechanism for SMEs, and improve the awareness rate, sense of acquisition and satisfaction of policies. Regularly carry out the third-party evaluation of the development environment of small and medium-sized enterprises, and publish the results to the public.
