National Day for Helping the Disabled
editorial comment/note Today is the 33rd National Day for Helping the Disabled. A few days ago, the China Disabled Persons’ Federation held a national conference on the theme of helping the disabled, and determined that the theme of this day was to improve the social security system and care service system for the disabled and promote the all-round development of the cause of the disabled. All bright and progressive undertakings must involve procuratorial forces. Supervise and promote the cleaning of blind roads, improve the sound prompting device of intersection signal lights, ensure the barrier-free connection of subway entrances and exits, build barrier-free rooms in hotels, and take the initiative to help disabled parties involved in the case … This issue of the same topic reports six stories about procuratorial organs actively performing their duties to help the disabled, in order to respond to the great love in the world with procuratorial positive energy.
12 reception hotels have been rectified.
Prosecutors of Gongshu District Procuratorate in Hangzhou, Zhejiang Province "looked back" on the renovation of barrier-free rooms.
The door width of the guest room is expanded to 90cm, the height of the bed surface of the bedroom is increased to 45cm from the ground, a safety grab bar is added in the bathroom, the shower area is spacious and has no threshold, a shower stool is specially set up, and the guest room is also equipped with a call device for help.……Recently, Li, a disabled person, experienced the renovated barrier-free room in a well-known five-star hotel in downtown Hangzhou, Zhejiang Province. Whether checking in or taking a bath in the toilet, he was deeply impressed by the accessible rooms with complete details.
But a few months ago, this was not the case. At that time, volunteers on the platform of "Benefiting the Heart for the Public" reported to the Gongshu District Procuratorate in Hangzhou that the original barrier-free rooms in a five-star hotel were cancelled, leaving the elderly and disabled people with inconvenient travel with one less choice.
After receiving the clue, the prosecutor immediately inspected the five-star hotel in the downtown area and found that it was also the official reception hotel for the Asian Games and the Asian Paralympic Games in Hangzhou. In 2005, the hotel set up two barrier-free rooms when participating in the evaluation of five-star hotels, which brought a lot of convenience to the disabled groups who came to Hangzhou for tourism, medical treatment and business trip. In recent years, affected by the epidemic, in order to reduce operating costs, the hotel demolished the original barrier-free rooms and rented the whole floor to a third party, and then no barrier-free rooms were added.
The procuratorate believes that the hotel’s practice violates the relevant laws and regulations on star rating of tourist hotels, infringes on the legitimate rights and interests of special groups to participate in social life on an equal footing, and harms the public interests. On the basis of multi-party investigation, Gongshu District Procuratorate issued pre-litigation procuratorial suggestions to relevant functional departments according to law, urging them to rectify according to law.
In March this year, at the invitation of relevant functional departments, district barrier-free office and hotel industry association, the hospital continued to follow up the progress of barrier-free facilities renovation project of hotels involved. At the same time, the prosecutor also invited experts in the field of barrier-free environment construction, volunteers on the platform of "benefiting the heart for the public" and representatives of disabled people to participate in the acceptance evaluation, so as to help the hotel reduce the renovation cost and respect its traditional style on the premise of ensuring compliance with relevant national standards. "The mobility accessible room has been upgraded!" The disabled people who participated in the acceptance evaluation lamented.
Under the impetus of the procuratorate, the relevant functional departments made a comprehensive investigation of the official reception hotels of the Asian Games and the Asian Paralympic Games within the region, and carried out centralized renovation of hotels that did not meet the standards for barrier-free facilities construction. By the end of April, a total of 12 official reception hotels of the Asian Games and the Asian Paralympic Games had been rectified, and 70 problems had been rectified.
Hangzhou Asian Games and Asian Paralympic Games are just around the corner. Perfect barrier-free facilities are an important support for the disabled and other special groups to enjoy the Asian Games, and also an important window to show the progress of social civilization. "In addition to serving the disabled, barrier-free environment construction also requires barrier-free environment for the elderly, injured patients, infants, minors, pregnant women and other groups. We must promote the improvement of barrier-free environments such as blind roads, barrier-free buses, barrier-free passages, barrier-free elevators, barrier-free toilets, and barrier-free rooms through public interest litigation, so that special people can go out, travel safely, live comfortably, and have dignity and fun. " On the eve of the National Day for Helping the Disabled, the prosecutor said when he looked back at the renovation of barrier-free rooms.

"In the future, I will definitely stand on my own feet."
"The property company retained me. It is close to home, so it is convenient for me to take care of my mother. " A few days ago, the prosecutor of Fuqing City Procuratorate of Fujian Province paid a return visit to the community where Xiaomou worked. Xiaomou promised to the prosecutor: "I will remember your warnings, abide by the law and stand on my own feet."
In 2006, Xiaomou was disabled due to a traffic accident. In September 2021, he saw a small advertisement on the Internet, saying that as long as he used his ID card to handle a bank card and then lent it to others, he could easily make money. Xiaomou was tempted, but he failed to do so because his bank card had a transfer limit. Later, I heard that introducing others to transfer money can also earn royalties, so Xiaomou asked Chen Mou, who is also a disabled person, to apply for a bank card as required, and cooperated with the transfer, so the two made profits in 600 yuan respectively. Because the 36,000 yuan that assisted in the transfer was fraudulent, the actions of Xiao Mou and Chen Mou were suspected of committing a crime. After that, Chen Mou surrendered himself voluntarily and assisted the public security organs to capture Xiaomou.
In December, 2021, the public security organ brought Xiao to Fuqing City Procuratorate for examination and arrest on suspicion of concealing and concealing the crime. The prosecutor in charge of the case learned that Xiao was physically disabled at the third level and could not do heavy work. His mother was ill in bed for a long time and his family economy was very difficult. Xiaomou told the prosecutor that he was most worried that his mother would be left unattended in the future.
In view of the fact that Xiao was a first-time offender and an occasional offender, he pleaded guilty and pleaded guilty after the case, and actively withdrew from the illegal income, Fuqing City Procuratorate made a decision not to approve his arrest. In October 2022, the case was transferred for review and prosecution. On March 10th this year, the hospital made a relative non-prosecution decision against Xiao Mou and Chen Mou based on the comprehensive case. "If you are physically and mentally disabled, please stand on your own feet and strive to create a better life." When the decision not to prosecute was announced, the prosecutor’s admonition made Xiao Mou and Chen Mou nod with tears.
The case was settled, but Xiaomou had no skills, relying on odd jobs to make a living and taking care of his mother. His difficult situation kept the prosecutor concerned. They contacted the village Committee where Xiaomou lived and worked with the village cadres to find a suitable job for Xiaomou. Knowing that a property company in a neighborhood near Xiao’s home is recruiting employees, prosecutors and village cadres found the person in charge of the property company, introduced Xiao’s situation, and won a trial opportunity for him.
"Xiaomou’s performance has been recognized by the property company and the owner and has turned positive." The prosecutor told reporters.

Wheelchairs go all the way in and out of the subway
In huqiu district, Suzhou City, Jiangsu Province, after the rectification of the barrier-free facilities in the subway station was completed, the prosecutor invited Xiao Su (middle), a disabled person, to experience the convenient passage from the barrier-free elevator to the curb ramp.
"Barrier-free access and curb ramps have both been built, which is especially thanks to the promotion of the procuratorate. Traveling smoothly, my heart is also comfortable. " Recently, witnessed by the Procuratorate of huqiu district, Suzhou, Jiangsu Province, Suzhou Rail Transit Group Co., Ltd. (hereinafter referred to as "the Municipal Rail Transit Company") and the street where the subway station belongs, Xiao Su (pseudonym), a disabled person, personally experienced the safety and convenience brought by the rectification of barrier-free facilities and sent out feelings in the circle of WeChat friends.
In September, 2022, Xiaosu got out of a subway station in Suzhou by wheelchair and found that it was surrounded by steps and curbs. The height difference between curbs and the ground was 15 to 20 cm. This puzzled him so much that he had to ask the station staff for help.
Xiao Su, who has worked as a salesman in the assistive devices company for the disabled, is very sensitive to the user experience of the disabled. He reflected his problems to the public service hotline and gave suggestions for the reconstruction of the kerb ramp. The clue was transferred to the municipal rail transit company for processing, but the relevant reply made him a little frustrated. It turns out that the construction will endanger the safety of pipelines because of the laying of various pipelines such as power and communication below the steps. The city rail transit company said that it will set up information notice boards, and the station staff will give relevant people help. Soon, Xiao Su saw the notice board, but it was really inconvenient to ask the staff for help every time he left the station.
In October, 2022, in a communication with Suzhou Disabled Persons’ Federation, Xiao Su learned that the public interest litigation function of the procuratorial organ may promote the solution of the problem. He sent a letter to the Suzhou Procuratorate for help, and the clue quickly passed to the huqiu district Procuratorate.
The prosecutor went to the scene to check and confirm that the situation reflected by Xiaosu was true, and the concerns of the city rail transit company were also reasonable. The procuratorial organ negotiated with the pipeline ownership department, and after on-the-spot investigation by relevant technicians, the other party said that it could come up with a feasible plan and follow up the guidance during the construction to ensure that the pipeline operation and ramp reconstruction are "correct". The professional problems have been solved, and the particularity of the subway station has brought new problems: although the subway station is located in the territorial jurisdiction, there is no clear stipulation whether the area around the outbound platform is managed by the municipal rail transit company or by the territorial management, and it is impossible to determine the responsible subject for the implementation of the transformation. The prosecutor asked the District Natural Resources and Planning Bureau about the ownership and management of the relevant plots, and found that the setting of barrier-free ramps needs to cross the jurisdiction of both parties and must be solved together.
In March this year, the huqiu district Procuratorate took the lead in holding a seminar on rectification plan, inviting the municipal rail transit company and representatives of local streets to participate. All parties indicated that they would work together to complete the construction of barrier-free facilities, and the specific implementation plan would soon land: on the north side of the subway exit, under the guidance of the pipeline ownership department, the local streets will carry out the kerb ramp reconstruction; On the other side, a barrier-free passage is added by the rail transit company to seamlessly connect with the sidewalk.
"We visited and saw that the parked electric cars blocked the subway exit. I suggest that you step up inspections, set up no-stop signs, etc., standardize the parking order, and make every effort to ensure that wheelchair people can get out. " The prosecutor’s suggestion was also supported by the local streets.
After two months, the rectification of barrier-free facilities in subway stations was all in place. During the rectification, the prosecutor kept close contact with Xiao Su and listened to his opinions at any time. In April this year, the prosecutor invited Xiaosu to experience the rectification effect on the spot. After Xiaosu’s experience, in addition to Wechat’s "hair circle" sigh, she also wrote a thank-you letter and sent it to the Suzhou Procuratorate: "We disabled people are more confident to go out in the future."
It is understood that the huqiu district Procuratorate, in conjunction with the Municipal Rail Transit Company, has inspected 23 subway stations in its jurisdiction one by one to ensure that the barrier-free access of each station can be smoothly connected with other barrier-free facilities in the city, and to promote the barrier-free facilities to form a complete chain, so that people with disabilities can have no obstacles all the way.

Let the traffic lights "talk" to the blind
Prosecutors of Shenzhen Procuratorate of Guangdong Province paid a return visit to the construction of sound warning facilities at intersections.
"I don’t know if that moment is a red light or a green light. I can only judge whether I can pass by the sound of traffic. There are many times when I can’t judge, I am allowed to go to the middle of traffic. A speeding car passed by, and the sense of helplessness was really desperate. " Mr. Ma, a visually impaired person who lives in Shenzhen, Guangdong, told reporters about the scene when crossing the road in the past, and he still has a lingering fear. Fortunately, now he has bid farewell to his previous predicament, because the traffic lights can "talk".
In June 2022, when the Shenzhen Procuratorate visited the Municipal Association for the Blind, Mr. Ma, a representative of the visually impaired, reflected to the prosecutor the difficulty of crossing the road. The Shenzhen Procuratorate immediately conducted a special investigation on the lack or abnormal use of the crosswalk sound prompting device in its jurisdiction. The prosecutor found that there were no sound warning devices for crossing the street at the sidewalks around many main roads, commercial areas and residential areas in the city. Even at the intersections that had been set, there were problems such as not being enabled, the sound was too small, and the switch settings were not standardized, which made it unable to play a role. "The absence or non-normal use of the signal light audio prompting device will affect the visually impaired groups to travel independently and safely. This problem cannot be ignored." The Shenzhen Procuratorate decided to promote the solution of the problem through public interest litigation.
On December 8, 2022, the institute took the lead in holding a pre-litigation consultation meeting on administrative public interest litigation. In addition to inviting representatives of relevant administrative organs and blind associations to attend the meeting, some people’s supervisors also attended the meeting for supervision and guidance. At the meeting, the representative of the Municipal Association for the Blind put forward an initiative to improve the sound prompting device for crossing the street. Through live video of blind people crossing the street, the participants can intuitively feel the embarrassment of visually impaired groups.
After the meeting entered the discussion session, everyone expressed their opinions. "Disabled people travel less. Is it necessary to install audible warning devices at all intersections?" "Barrier-free environment construction is related to the improvement of the connotation of humanistic society and the quality of life. Although it is used by a few people, its essence is to benefit all members of society. The number of users cannot be used as an evaluation condition for the necessity of installation." "There have been audible prompts before, and some people don’t quite understand them, especially when there is noise at night, so they will be removed or stopped." "The noise problem can be solved by scientific and technological means, and other cities have had successful experience in this regard." After nearly two hours of in-depth consultations, everyone reached an agreement on the rectification plan.
Recently, the Shenzhen Procuratorate followed up and supervised the implementation of the opinions of the consultation meeting. "324 signalized intersections that have not installed sound warning equipment for crossing the street have been deployed and supplemented; 636 Class A intersections that need to be installed urgently and 2067 Class B intersections that need to be installed have formed planning and construction plans, and opinions are being sought; 1964 at 235 intersections has the sound of crossing the street to remind that the equipment has been inspected and repaired, and it is in normal operation. " According to the prosecutor handling the case, in response to the problem of disturbing people by the noise of crossing the street reflected by some people, the relevant departments have demonstrated the new intelligent sound solution for crossing the street, which will be piloted soon.
"It’s convenient to travel now, I believe tomorrow will be better!" Mr. Ma expressed his gratitude to the prosecutor and was full of confidence in equal participation in social life.

The blind road has been restored to its proper "emptiness"
On one side of the straight pedestrian passage, the orderly parking piles extend to the distance, and the illegally parked motor vehicles on the blind road disappear without a trace. Recently, the prosecutor of Hanyang District Procuratorate in Wuhan, Hubei Province invited street workers and residents’ representatives to a street in the jurisdiction to "look back" and found that the blind road originally occupied by vehicles had been restored to its proper "emptiness".
At the end of 2022, the Hanyang District Procuratorate’s "Public Welfare has You" case-handling team launched a special campaign to protect barrier-free facilities. Prosecutors went deep into more than 20 sections of more than 10 streets in the jurisdiction to conduct on-the-spot investigations and visit surrounding residents. At the same time, they invited public interest litigation observers to play the role of "clairvoyance" and "clairvoyance" and provide relevant clues on the platform of "benefiting the heart for the public" to help prosecutors handle cases.
Based on the investigation and the clues provided by the observers, the prosecutor found that vehicles occupied the blind roads in many sections of some streets in the jurisdiction, and the blind roads were damaged, which brought great security risks to the travel of special groups, which was not conducive to ensuring the participation of special groups in social life and infringing on social public interests. At the same time, the prosecutor also learned that objective reasons such as insufficient funds have also affected the upgrading of barrier-free facilities such as blind roads.
After going to various streets for investigation and talks one by one, and after many consultations, Hanyang District Procuratorate issued procuratorial suggestions to relevant functional departments. Relevant functional departments acted quickly, stepped up publicity while carrying out joint law enforcement, sent short messages to owners of vehicles illegally parked on blind roads, issued parking penalty sheets, and pushed electronic proposals on non-random parking through community WeChat groups, with more than 3,000 hits. In order to fundamentally solve the phenomenon of disorderly parking, the relevant functional departments have also upgraded the roads and set up car blocking piles to better protect the blind roads.
"After the procuratorial organs sent us procuratorial suggestions, we have started to upgrade and transform four roads in the jurisdiction. At present, the upgrading and transformation of one road has been completed." Returning to the site, the staff of relevant functional departments introduced to reporters. "People call, inspection should be. The procuratorial organs take the initiative to work with relevant functional departments to safeguard the legitimate rights and interests of visually impaired people, which is very powerful! " Ms. Li, a volunteer on the platform of "Benefiting the Heart for the Public", followed up and supervised the whole process and expressed satisfaction with the rectification effect.
"Many difficulties faced by visually impaired people in their lives are beyond ordinary people’s perception. A smooth blind road seems inconspicuous, but it is their necessity. " The prosecutor said that they will continue to strengthen communication and cooperation with relevant functional departments, continue to pay attention to the construction of barrier-free environment in the jurisdiction, earnestly safeguard the legitimate rights and interests of special groups, and make "love" without "hindrance".

After the fire, the relief fund solved the family’s emergency.
The procurator of Laiyuan County Procuratorate in Hebei Province paid a return visit to Liu to learn about his condition and medication.
"The house has been repaired and we have moved back. Thank you, judicial assistance funds have come in handy. " A few days ago, when the procurator of Laiyuan County Procuratorate of Hebei Province paid a return visit to Liu, the object of judicial assistance, Liu introduced the recent family situation.
There are four disabled people in Liu’s family of five, her husband is disabled in the second degree, both sons are blind, and her grandson has mental retardation. In 2021, Liu suffered from a cerebral infarction. I didn’t expect the house to leak when it rained all night, and a fire put the family in a bigger predicament.
On April 26, 2022, when Duan, an 8-year-old neighbor, was playing near Liu’s home, he lit the firewood pile with a lighter. Liu’s house was burned down, and Liu’s family could only go to relatives to stay temporarily. Duan’s parents divorced, his father worked outside all the year round, and Duan had been living with his grandfather. On the day when the public security organ decided not to file a criminal case, under the auspices of the village Committee, the two sides reached a mediation agreement, and Duan’s grandfather compensated Liu for RMB 3,000 and repaired the house.
After Duan’s grandfather paid all his compensation of 3000 yuan, he was unable to repair the house. Liu appealed to the court. Although he was supported by the judgment, Duan’s grandfather really had no property to enforce. In June 2022, the Laiyuan County Procuratorate carried out supervision over the execution of civil cases, and this tragedy caused by children playing with fire entered the prosecutor’s field of vision. "The amount involved in this case is not much, but both families are very difficult. The perpetrator is a left-behind child, and my grandfather is willing to pay compensation, but he can’t get the money. We have contacted the father of the child. His income from working outside the home is very low and he is powerless. " The executive judge introduced to the prosecutor.
The prosecutor immediately contacted Liu to explain the scope and conditions of the application for judicial assistance and ask his wishes. Liu was overjoyed and immediately expressed his hope for help. Subsequently, the prosecutor joined the county civil affairs bureau, the Disabled Persons’ Federation, the Women’s Federation and the town government staff to visit Liu’s home. "There is nothing more difficult in this village than her family. A family of five with four disabled people lives on subsistence allowances. However, Duan Jia is just as difficult and can’t get money at all. " The villagers told the prosecutor.
According to the review of Wuyuan County Procuratorate, Liu meets the requirements of national judicial assistance. At the same time, considering that her husband has physical disability, her two sons have visual disability and her grandson has intellectual disability, they are all key targets of judicial assistance, and decided to open a "green channel" for Liu to speed up the application for judicial assistance. In October 2022, 8,000 yuan of aid was paid in place, which timely filled the funding gap for Liu to repair the house.
